BUSINESS & COMMERCIAL TIER 2
Basic Information
This type of Work Permit enables a company to recruit the skilled individual they require from outside the EU, provided that a suitable UK or EU candidate cannot be found.
It will only allow a named individual to be employed in a specific role for that employer. The employer must be an established UK business, with a verifiable physical and trading presence.
It goes without saying that the pay & conditions offered to the candidate must match those offered to a resident worker in the same role.
Criteria
The postion for which the Work Permit is sought must meet NVQ (National Vocational Qualification) Level 3 or above. If the candidate works in a profession, they may be required to register with the governing body of that profession. E.g. A doctor must be registered with the GMC.
Education: A Work Permit UK visa candidate must have either:
- a degree equivalent to UK degree standard; or
- an HND (Higher National Diploma) level qualification which is relevant to the post on offer, or
- an HND (Higher National Diploma) level qualification which is not relevant to the post on offer plus one year of relevant full time work experience at NVQ (National Vocational Qualification) level 3 and above, or
- no degree and three years of relevant experience.
The position must have been advertised in a suitable media (such a national newspaper / industry journal) for at least 28 days in the previous 6 months.
However, the last point can be waived for Tier 1 applications, for example in the case of shortage occupations, where advertising may be exceedingly unlikely to yield a result.
