SWITCHING TO HSMP
Individuals from non-EEA countries can apply to switch to the Highly Skilled Migrant Programme without leaving the UK provided they have existing leave as one of the following:
- Work permit holder (excluding TWES and SBS)
- Student who has gained a degree level qualification at a UK university or other further educational institution during their current period of leave; and have the written consent of their sponsor to remain as a highly skilled migrant if they are a member of a government or international scholarship agency and that sponsorship is either ongoing or has recently come to an end
- Postgraduate doctor or a postgraduate dentist or trainee general practitioner
- Working holidaymaker
- Science and Engineering Graduate Scheme participant
- Innovator
- Fresh Talent: Working in Scotland scheme participant; who have the consent of their sponsor where appropriate.
Switching from any categories other than those stated above is strictly forbidden except in exceptional circumstances. These circumstances are assessed on a case-by-case basis. Circumstances relating to the job, employment and labour market will not be accepted as exceptional circumstances. Only circumstances relating to the individual which would make it unduly harsh for them to return to their own country will be considered as exceptional.
Other candidates in the UK wishing to apply for the HSMP should return to their own country as their FLR (IED) application will be refused.
