WHO IS EXEMPT?

 

Below is a list of people that are exempt from the requirement to obtain work authorisation in the UK:

 

1. You already have leave to enter / remain without any restrictions on your ability to take up employment, e.g. as the dependant of a work permit holder or spouse of a British citizen.
2. You have been working with permission, and without interruption, in the UK for 12 months ending on or after 31st December 2006. E.g. you have been a work permit holder, or student in part-time employment for 12 months.
3. You are providing services in the UK on behalf of an employer established elsewhere in the EEA.
4. You are also a citizen of the UK or another EEA state, other than Switzerland.
5. You are the family member of an EEA national exercising a treaty right in the UK or the spouse of or partner of a British citizen or person with settlement in the UK.
6. You are the family member of a Bulgarian or Romanian national who is self-employed, self-sufficient or a student.

 

You should bear in mind that even if you are not required to obtain an authorisation document to prove your status in the UK, e.g. if you are self-employed or self-sufficient, it is often in your best interests to apply anyway in order to demonstrate that right if challenged.

 

Most employers do not have all the information readily available to them about who has the right to work in the UK and may refuse to employ you without official proof of your exempt status.

 

Individuals that fall into categories b and f above particularly may not be able to prove their right to work without obtaining the Blue Registration Certificate.

I'M NOT EXEMPT - DOES THIS MEAN I CAN'T WORK IN THE UK?

 

Not at all! There are still several routes available to you.

 

First let’s discuss the Purple Accession Worker Card. You’ll need to apply for this if you qualify for a work permit or fall into one of the specified categories of employment.
